Terms of Service
Effective date: October 15, 2026
These Terms of Service (“Terms”) are an agreement between you (“Customer”, “you”) and Digital Vision Code LLC (“we”, “us”), for the use of amabledata. By creating an account or using the service you accept these Terms. If you accept them on behalf of an organization, you confirm that you are authorized to bind it.
1. The service
amabledata is an all-in-one CRM and marketing automation platform available in two editions built from the same codebase:
- amabledata Managed: a paid subscription. We install the software on your own Cloudflare account, keep it updated, monitor its errors and health, and provide central services such as included email sending, ready-to-use Google and Meta integrations, the customer portal at app.amabledata.com and support.
- amabledata Open Source: the software released under the GNU Affero General Public License v3.0, which you can self-host on your own Cloudflare account free of charge. It is governed by that license; only sections 8 and 10 of these Terms apply to it.
2. Account
- You must provide accurate and complete information and keep it up to date.
- You are responsible for your credentials and for all activity under your account and those of your users.
- Two-factor authentication is mandatory for every user and cannot be disabled.
- We may suspend an account in case of misuse, a security risk or a breach of these Terms. Where reasonable, we will warn you first and explain why.
3. Subscription, billing and wallet
- The managed edition costs $99 per month, billed in advance through Stripe. Applicable taxes are added where required.
- The subscription renews automatically every month. You can cancel at any time; cancellation takes effect at the end of the current billing period.
- The subscription includes 10,000 marketing emails per month. Additional emails are paid with prepaid wallet creditsat $1 per 1,000 emails. Wallet credits are non-refundable and can be used while the subscription is active.
- We will give you at least 30 days’ notice of any price change. If you do not agree, you can cancel before it takes effect.
- If a payment fails, a 7-day grace period applies. After that, updates and central services are paused until payment is received. Your installation itself keeps running and your data stays with you.
4. Your Cloudflare account
- You provide, and remain the owner of, a dedicated Cloudflare account on which amabledata is installed.
- Cloudflare bills its usage costs directly to you under its own terms. They are not part of our price.
- You grant us an API token for that account. We use it solely to install, update and operate the software, and never for any other purpose. You can revoke it at any time; while it is revoked, updates and central services cannot work.
5. Acceptable use and anti-spam
You may only process data you are lawfully entitled to process. For email marketing in particular:
- you send marketing email only to recipients who have given valid consent, or where another legal basis applies under the law of the recipient;
- purchased, rented or scraped lists are prohibited;
- sending requires a verified sender domain, authenticated with SPF, DKIM and DMARC;
- every broadcast must include a working unsubscribe link and your postal address;
- excessive bounce or spam complaint rates trigger an automatic suspension of sending, to protect recipients and other senders.
You must not use amabledata to:
- send spam, phishing or deceptive messages, or impersonate others;
- distribute malware or attempt to gain unauthorized access to any system;
- publish or send illegal content, content that infringes the rights of others, or content that promotes violence, hatred or discrimination;
- collect or process sensitive data without a valid legal basis, or track people in violation of applicable law;
- interfere with the security or the operation of the service or of our central services.
6. Customer data and roles
- You own the data you store in amabledata (“Customer Data”). It is stored in your Cloudflare account and you are its data controller. Where we process personal data on your behalf, we do so as your processor under a data processing agreement.
- You can export your Customer Data at any time.
- We access your installation only through assisted access that you explicitly grant: by default it lasts 5 days, you can revoke it at any time, and every access is recorded in the audit log.
7. Third-party integrations
Connections to Google, Meta, Stripe and other third parties are optional and are activated only with your authorization. Their use is also governed by the terms of those third parties. You can revoke them at any time from the dashboard or from the third party’s settings. How we handle the data they provide is described in our Privacy Policy.
8. Intellectual property and licenses
- We own the intellectual property in the amabledata software, brand and website, except for the rights granted below.
- The open source edition is licensed under the GNU Affero General Public License v3.0. Nothing in these Terms limits the rights that license grants you.
- The amabledata name and logo are not licensed for use as your own brand.
- Your content and Customer Data remain yours.
9. Support
Managed customers can open a support ticket from the app or from the portal at app.amabledata.com. We aim to answer every ticket promptly, starting with issues that block your work. These are targets, not a binding service level agreement. Open source users are supported by the community.
10. Warranty disclaimer
To the extent permitted by law, the service and the software are provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not guarantee that the service will be uninterrupted or error-free.
11. Limitation of liability
- To the extent permitted by law, we are not liable for indirect or consequential damages, including loss of profits, revenue, data or goodwill.
- Our total liability arising from these Terms is limited to the fees you paid us in the 12 months before the event giving rise to the claim.
- These limitations do not apply to liability that cannot be limited by law, such as liability for wilful misconduct or gross negligence, or to the rights of consumers under mandatory law.
12. Termination
Either party can terminate the subscription: you by cancelling it, we with 30 days’ notice, or immediately in case of a serious breach of these Terms. On termination, updates and central services stop. The installation and its data remain in your Cloudflare account, under your control.
13. Changes to these terms
We may update these Terms. We will notify you of material changes by email or in the portal before they take effect. Continuing to use the service after that date means you accept the updated Terms; if you do not, you can cancel.
14. Governing law and venue
These Terms are governed by the laws of the State of Florida, USA. If you are a consumer, the court of your place of residence or domicile has jurisdiction where mandatory law provides so. In all other cases, the state and federal courts located in Pinellas County, Florida have exclusive jurisdiction.
